Legal liability policy

1. Software and templates only

OHS SMART is a software tool that generates template health and safety documents from the information you enter. It is practical help only. It is not a law firm, not an appointed 16.1 / 16.2 / 8.1 person, not a professional engineer, and not your health and safety officer.

OHS SMART does not give legal advice. Generating a file does not mean the file is complete, accurate, site-specific enough, or legally compliant.

2. Use of documents is at your own risk

You generate, download, print, complete, sign, file and use documents at your own risk. You must check every document against the actual site, the work being done, the client specification, and current South African law before anyone relies on it.

Trial files carry a Preview watermark and are not for site use. Paid files are still templates. You remain responsible for filling blanks, attaching competency evidence, briefing workers, and keeping documents current.

3. No liability for incidents or accidents

The developer, the operator of OHS SMART, and OHS SMART itself take no legal liability for any incident, accident, injury, occupational disease, fatality, property damage, stoppage, fine, prosecution, civil claim or other loss that happens on a site or in connection with work, whether or not a file or document from this app was generated, downloaded or used.

That includes claims that a document was missing, incomplete, wrong, outdated, or not followed.

4. You stay the responsible person

You (the employer, contractor, client or appointed person) remain fully responsible for compliance with the Occupational Health and Safety Act 85 of 1993, the Construction Regulations, COIDA, the Mine Health and Safety Act where it applies, and any other law, client specification or municipal requirement.

Nothing in this app transfers those duties to the developer or the operator.

5. No warranties

To the fullest extent permitted by South African law, OHS SMART is provided as is. We do not warrant that documents are error-free, complete, or fit for a particular site, tender or audit.

Where the law does not allow a limitation, our liability is limited to the amount you paid for the specific generate or pack that the claim relates to, and not to any wider loss.
